1. Account Creation and Verification

1.1 Account Creation: In order to access certain features of the App, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.2 Account Verification: Upon registration, you must verify your email address. Failure to verify your email address may result in limited access to the App’s features.

2. Use of the App

2.1 Personalization Process: To generate personalized itineraries you must complete the personalization process within the App. This includes providing accurate information about your destination, travel dates, itinerary start and end times, who you are traveling with, budget, and experience preferences.

2.2 Payment and Tour Generation: For tours generated you agree to pay the specified fee before our AI starts generating the tour. Payment details and options will be provided within the App. The tour generation process will begin once the payment is successfully processed.

3. Intellectual Property

3.1 Ownership: The App, its content, and all related intellectual property rights are owned by Hysa Tech. You agree not to copy, modify, distribute, or create derivative works based on the App or its content, unless expressly authorized by us.

3.2 User-Generated Content: By using the App, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display any content you submit or generate through the App. This includes user-generated reviews, feedback, or other materials.

4. Limitation of Liability

4.1 Disclaimer of Warranties: The App and its content are provided on an “as-is” and “as available” basis. We make no warranties or representations, express or implied, regarding the App’s accuracy, reliability, or suitability for any purpose.

4.2 Limitation of Liability: In no event shall Hysa Tech, its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App. This includes damages for loss of profits, data, or other intangible losses, even if advised of the possibility of such damages.

5. Dispute Resolution

5.1 Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Albania. Any legal actions arising out of or in connection with these Terms shall be brought exclusively in the courts of Albania.

6. Termination

6.1 Termination by Us: We reserve the right to terminate or suspend your access to the App at any time and for any reason, without prior notice or liability. Upon termination, your right to use the App will immediately cease.

6.2 Termination for Violation: We may terminate your access to the App if you violate any provision of these Terms or engage in any conduct that we deem harmful or offensive.

7.1 Modification of Terms: We reserve the right to modify these Terms at any time. Any changes to the Terms will be effective immediately upon posting the updated version within the App. Your continued use of the App after the posting of changes constitutes your acceptance of the modified Terms.

7.3 Entire Agreement: These Terms constitute the entire agreement between you and Hysa Tech regarding your use of the App, superseding any prior agreements or understandings.

7.4 Google Places API Usage: The App uses the Google Places API to provide location-based services, including recommendations, maps, and location-related information. By using the App, you acknowledge and agree to be bound by Google’s Terms of Service and the Google Privacy Policy regarding the use of the Google Places API.

7.5 Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
