Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Hysa Tech ("Company", "we", "our", or "us") governing your access to and use of all mobile applications published by Hysa Tech — including but not limited to TourAI, DreamscapeAI, WhereShot, Nutrio, and Nica (each, a "Licensed Application" and collectively, the "Applications") — on any device or platform.

By downloading, installing, accessing, or using any Application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policies. If you do not agree to these Terms, do not download, install, or use any Application.

1. License Grant & Scope

Subject to your compliance with these Terms, Hysa Tech grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Licensed Application for your personal, non-commercial purposes on devices that you own or control.

This license does not allow you to:

Distribute or make the Licensed Application available over a network where it could be used by multiple devices or users simultaneously, unless authorized by separate agreement.
Transfer, redistribute, sublicense, rent, lease, lend, or otherwise make the Application available to any third party.
Copy the Licensed Application except as expressly permitted by these Terms or applicable law.
Reverse-engineer, disassemble, decompile, decode, or attempt to derive the source code of the Application, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Modify, adapt, create derivative works from, or translate any part of the Application without prior written consent from Hysa Tech.
Remove, alter, or obscure any proprietary notices, labels, or marks on the Application.

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to create an account and use our Applications. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Applications with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Applications, you represent and warrant that you meet these eligibility requirements.

3. Account Registration & Security

Certain features of our Applications require you to create an account. When you do so, you agree to:

Provide accurate, current, and complete information during registration.
Maintain and promptly update your account information to keep it accurate.
Maintain the security and confidentiality of your login credentials.
Accept responsibility for all activities that occur under your account.
Notify us immediately at [email protected] if you suspect unauthorized access to your account.

4. Subscriptions, Payments & Free Trials

4.1 Free Tier & Premium Features

Our Applications may offer both free and premium (paid) features. Free features may be limited in functionality. Premium features are accessible through an active subscription.

4.2 Free Trials

We may offer free trial periods for premium features. The duration of the free trial is specified in the Application at the time of enrollment. Unless you cancel before the end of the trial period, your subscription will automatically convert to a paid subscription, and you will be charged the applicable subscription fee.

4.3 Billing & Renewal

Subscriptions are billed in advance on a recurring basis (weekly, monthly, or annually) depending on the plan selected.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Your payment method will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

4.4 Managing & Cancelling Subscriptions

Google Play: Manage subscriptions in your Google Play Store account settings under Subscriptions.
Apple App Store: Manage subscriptions in your Apple ID account settings under Subscriptions.
Other platforms: Follow the subscription management instructions provided in the Application or by the platform through which you subscribed.

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that period expires. Uninstalling the Application does not cancel your subscription.

4.5 Refunds

Payments are processed by the platform through which you subscribed (Google Play, Apple App Store, or other applicable platform). Refund requests are subject to the refund policies of the respective platform. Hysa Tech does not directly process payments or issue refunds. 5. User Conduct & Acceptable Use

You agree not to use any Application to:

Violate any applicable local, national, or international law or regulation.
Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Interfere with or disrupt the Application, servers, or networks connected to the Application.
Attempt to gain unauthorized access to the Application, other accounts, computer systems, or networks connected to the Application.
Use any automated means (bots, scrapers, crawlers) to access the Application or collect data from it.
Use the Application to send spam, unsolicited messages, or advertisements.
Exploit the Application for any commercial purpose not expressly authorized by these Terms.

6. User Content

Certain Applications allow you to create, upload, or submit content (including but not limited to photos, text, meal logs, travel itineraries, and dream entries) ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant Hysa Tech a limited, non-exclusive, royalty-free license to process, store, and display your User Content solely to provide and improve the Application's services to you.

You represent and warrant that:

You own or have the necessary rights and permissions to submit the User Content.
Your User Content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, or other legal rights.
Your User Content does not contain viruses, malware, or any harmful code.

We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

7. Intellectual Property

All intellectual property rights in and to the Applications — including but not limited to software, source code, algorithms, user interface designs, graphics, logos, trademarks, trade names, icons, animations, text, data compilations, and all other content — are and shall remain the exclusive property of Hysa Tech or its licensors. These Terms do not grant you any right, title, or interest in the Applications except for the limited license set forth in Section 1. All rights not expressly granted are reserved.

8. Health & Medical Disclaimer

Certain Applications (including but not limited to Nutrio and Nica) provide general nutritional, dietary, and health-related information for educational and informational purposes only.

The Applications are not medical devices and do not provide medical advice, diagnosis, or treatment. The information provided should not be relied upon as a substitute for professional medical advice from a qualified healthcare provider.

Always consult your physician, pediatrician, dietitian, or other qualified healthcare professional before making any changes to your diet, exercise routine, or your child's feeding practices — particularly if you or your child have known allergies, medical conditions, or special dietary requirements. You use any health-related features of the Applications entirely at your own risk.

9. Data Collection & Privacy

We may collect and use technical data and related information — including but not limited to device identifiers, operating system version, application version, and anonymized usage statistics — to facilitate software updates, product support, and service improvements.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by the Privacy Policy applicable to each Application. By using an Application, you consent to our data practices as described in the applicable Privacy Policy:

10. Third-Party Services & Content

The Applications may contain links to, integrate with, or rely on third-party services, websites, or content that are not owned or controlled by Hysa Tech (including but not limited to payment processors, analytics providers, and cloud infrastructure providers).

Hysa Tech has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that Hysa Tech shall not be liable for any damage or loss caused by or in connection with the use of or reliance on any third-party services. We encourage you to review the terms and privacy policies of any third-party services you access through our Applications.

11. Disclaimer of Warranties

THE APPLICATIONS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, Hysa Tech expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Warranties that the Applications will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Warranties regarding the accuracy, reliability, completeness, or timeliness of any content, information, or results obtained through the Applications.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions shall apply to the fullest extent permitted by applicable law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HYSA TECH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

Loss of profits, data, use, goodwill, or other intangible losses.
Damages resulting from unauthorized access to or alteration of your transmissions or data.
Damages resulting from any content or conduct of any third party within the Applications.
Any other damages arising out of or in connection with your use of, or inability to use, the Applications.

In no event shall Hysa Tech's total aggregate liability to you for all claims arising out of or related to these Terms or your use of the Applications exceed the greater of: (a) the amount you have paid to Hysa Tech in the twelve (12) months preceding the claim, or (b) fifty US dollars (USD $50.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless Hysa Tech and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Applications; or (d) your violation of any rights of a third party.

14. Termination

These Terms are effective until terminated by either you or Hysa Tech.

By you: You may terminate these Terms at any time by deleting the Application and your account (if applicable).
By us: We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason, including if you breach any provision of these Terms.

Upon termination, your license to use the Application will cease immediately. Sections 6, 7, 11, 12, 13, 15, and 16 shall survive termination.

15. Export Compliance

You may not use or export the Licensed Application except as authorized by the laws of the jurisdiction in which the Application was obtained and by applicable export control laws. In particular, the Application may not be exported or re-exported: (a) into any country subject to a U.S. Government embargo or sanctions; or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List, the U.S. Department of Commerce's Denied Persons List, or any similar restricted party list. By using the Application, you represent and warrant that you are not located in any such country or on any such list.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Albania, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be resolved first through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the competent courts of Albania.

If you are a consumer residing in the European Union, European Economic Area, United Kingdom, or Switzerland, you retain any mandatory consumer protection rights granted to you under the laws of your country of residence, and you may bring legal proceedings in the courts of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement & Waiver

These Terms, together with the applicable Privacy Policy, constitute the entire agreement between you and Hysa Tech regarding your use of the Applications and supersede all prior agreements, understandings, and communications, whether written or oral. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the affected Application(s) or by other reasonable means (such as email) at least fourteen (14) days before the changes take effect. The "Effective Date" at the top of this page indicates the date of the most recent revision. Your continued use of the Applications after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Applications.
